1. THE POLICY

Each individual is entitled to the security of his/her personal data. Triboo Digitale respects the right of its users to be informed on the collection and processing methods of their personal data. We take all possible measures to solely process information that may identify you, even indirectly, if strictly necessary. For this reason, we configured the Site to minimize the use of your personal data and to exclude processing when the scopes pursued in the single cases can be achieved by using anonymous data or through other methods that allow identifying the concerned party only if required or upon request of the authorities or police. This Privacy Policy provides all useful information to understand the methods to collect and use information that identifies the Site’s users. 2. SUBJECTS IN CHARGE TO PROCESS DATA, METHODS AND SCOPES

Triboo Digitale is the Data Controller of the Personal data of Dececco

] users, aimed at the management, conclusion and execution of sales transactions concerning the purchase of products through the Site ("Scopes"); Triboo Digitale decides the scopes and methods of the aforementioned data processing and instruments to implement, also with regards to the security profile. For solely organizational and functional purposes, we appointed a few external data processors of personal data concerning the Site’s users, for purposes strictly linked and related to render the services offered on the Site, including the sale of products. These data processors were selected for their skills, experience and reliability and also for showing suitable guarantee to fully comply with applicable laws on data processing, including the data security profile.  The data processors will process the personal data of the Site’s users according to the instructions imparted by Triboo Digitale.

In particular, in order to achieve the Scopes and within the purchase processes of products on the Site, we collect Personal Data (e.g. personal information, email address, mailing address, credit card and bank details, telephone number) through the order form for purchasing products on the Site.

Your personal data is mainly processed in electronic format and in some cases, also in paper format, for instance when it is required to process your data to prevent frauds on the Site.

Your personal data will be stored in a form that allows your identification for the time strictly required to attain the scopes for which it was collected and then processed and, in any case, within limits set forth by law. Without prejudice to the provisions set out in this policy, your personal data will not be disclosed to third parties for scopes not allowed by the law or without your explicit consent.

Your data can be disclosed to the police or legal authority, for instance in relation to anti-fraud services concerning the Site, in compliance with the law and upon request. Your data will also be disclosed to Data processors, as indicated in this paragraph 2, and for the specific scopes mentioned in the same paragraph. Your personal data cannot be transferred abroad, in extra-EU Countries which do not ensure suitable personal security levels.  If the above is required to attain the Scopes, we guarantee you that the transfer of your personal data to extra-EU Countries that do not ensure suitable security levels, will take place solely upon stipulation of specific agreements between Triboo Digitale and said subjects, containing suitable clauses concerning the privacy of your personal information, in compliance with applicable laws and regulations.

The scopes for which your personal data is collected are detailed from time to time, in the informative text displayed in the page where conferment of personal data is requested.

Triboo Digitale may process personal data of third subjects notified directly by its users to Triboo Digitale, e.g. when the user intends to notify a service or product sold on the Site to a friend, or when the user purchases a product to be delivered to a friend, or when the subject who pays the purchase price is different from the subject to whom the product is shipped.

In the aforementioned cases, you are invited to obtain the consent of the subject to whom the data refers before disclosing it to Triboo Digitale and inform the subject about this Privacy Policy since you will be the only liable party for disclosing information and data concerning third subjects without the explicit request of the latter, and for improper use or in breach with the law. Nonetheless, Triboo Digitale, within the limits set forth by law, will fulfill the duty to notify the mentioned user and if needed, will request his/her explicit consent for registering his/her personal data in its archives.

 

3. REFUSAL TO CONFER PERSONAL DATA AND CONSEQUENCES

It is required to confer your personal data to Triboo Digitale and in particular personal information, your email address, mailing address, credit/debit card and bank details and telephone number, in order to attain the Scopes.

Certain data may be required to fulfill the obligations set forth by laws or regulations or to supply other services offered on the Site and requested by you.

Refusal to confer certain compulsory data, identified in the Site with symbol (*), may prevent the execution of the product purchase order or to properly fulfill the obligations set forth by laws and regulations. Therefore, according to the cases, refusal to confer your data may constitute a legitimate and justified reason for not executing the purchase order of products on the Site or to render services through the Site.

The indication of additional Personal data to Triboo Digitale, other than those compulsorily required is instead optional and does not bear any consequence concerning the purchase of products on the Site.

 

4. SUBJECTS TO WHOM WE DISCLOSE PERSONAL DATA

The personal data can be disclosed to third parties who render specific services in quality of Data processors on behalf of Triboo Digitale or may be notified to other recipients of data collected by Triboo Digitale who process the information independently, solely for the purpose to execute the purchase order of products on the Site (e.g. Global Collect, to render payment services through credit/debit card) and only when said scope is not incompatible with other scopes for which your data has been collected and then processed and, in any case, in compliance with laws. 

The data will not be disclosed, rendered or transferred in any other way to other third subjects, without previously informing the users and obtaining their approval, if required by law.

 

5. HOW WE COLLECT YOUR DATA ON THE SITE

Triboo Digitale collects personal data and other information when registering to the Site online or when transmitting purchase orders of products on the Site to conclude e-sale transactions. The data is processed by Triboo Digitale within the limits and scopes described in the informative policy presented to the user in the specific data collection section. 

 

6. SECURITY MEASURES

We adopted security measures in order to minimize the risk of data destruction or loss,  even accidental, of non-authorized access or processing not allowed or not compliant with the collection purposes indicated in our Privacy Policy.

Nonetheless, since it is not possible to guarantee that the measures adopted for the security of the Site and transmission of data and information on the Site minimize or exclude any risk of non-authorized access or data leakage, please make sure that your computer features updated anti-virus software for the security of  incoming and outgoing web data transmission, and that your internet supplier has adopted suitable firewalls and anti-spamming filters for the security of web data transmission.

 

7. YOUR RIGHT TO ACCESS DATA AND OTHER RIGHTS

You are always entitled to obtain confirmation of the existence of your personal data, even if not yet registered, and its communication in intelligible form.

You are always entitled to obtain the following from Triboo Digitale:

- updating, correction or if needed, integration of your personal data;

- declaration that the aforementioned operations were notified, also with regards to their content, to those subjects to whom data has been notified or disclosed, except in case notification proves impossible or requires the use of means clearly disproportionate to the right being protected.

However, you will be entitled to object in full or partially:

- to the processing of your personal data for legitimate reasons, even if related to the collection purpose;

This Privacy Policy is regulated by Italian laws and in particular by the Code on personal data protection (Legislative Decree no. 196 of 30th June 2003) which regulates the processing of personal data – also held abroad – carried out by any subject who resides or boasts registered address in Italy or through instruments located in Italy.

The Code ensures that the processing of personal data takes place by respecting the fundamental rights, freedoms and dignity of the concerned party, with particular regard to the right to privacy, personal identity and protection of personal data.
