Information note on the processing of personal data

Your personal data are important to us and we want you to feel protected at all times. For this reason, we invite you to read this information note concerning processing carefully.
F.lli De Cecco Di Filippo Fara San Martino S.P.A (hereafter "De Cecco"), as data controller, wishes to inform you that pursuant to art. 13 of EU Regulation 679/2016 ("GDPR") your data will be processed as follows.
By using our services, you transmit or share with us some information which in some cases allows us to provide the service, in other cases to meet your needs and to improve. This document wishes to explain:

  1. who is the Data Controller of your data and who is the data protection officer
  2. what the purposes of processing your personal data are;
  3. how your data is used;
  4. how long your data is stored for;
  5. who can access your data;
  6. to whom your data may be transmitted;
  7. where your data may be transferred;
  8. what your rights are; 

This information note is valid only for processing personal data carried out through this website (https://www.dececco.com) and for the services offered through it. For any other personal data processing, including that concerning transactions of an economic nature, please refer to the additional specific information notes.
This website and its services are intended for subjects who are of age. The data controller does not collect personal data concerning persons under 18 years of age. At the request of users, the controller will promptly delete all personal data involuntarily collected and related to subjects under the age of 18.

1. WHO IS THE DATA CONTROLLER AND WHO IS THE DPO DATA PROTECTION OFFICER


For any need, remember that the Data Controller of your personal data is F.lli De Cecco di Filippo Fara San Martino Spa, located in via F. De Cecco, Industrial Area 66015, Fara San Martino (CH) - Italy.

2. WHAT ARE THE PURPOSES OF PROCESSING YOUR PERSONAL DATA

The data you provide are common identification data (e.g. name, surname, email, city, country) and will be processed in compliance with the requirements of EU Regulation 679/2016, for the following purposes:

  • without your prior consent:
    • for service purposes:
      • i. to allow browsing the website;
      • ii. to allow the use of services;
      • iii. to improve assistance, customer care activities, services, content and products through statistical analysis aggregated on an anonymous basis;
      • iv. to respond to specific user requests;
      • v. to comply with and carry out the obligations established by laws, rules and regulations, community regulations, orders and rules of the competent authorities;
    • for pursuing a legitimate interest of the data controller:
      • i. to manage complaints and disputes;
      • ii. to prevent fraud and illegal activities;
      • iii. to exercise and protect the interests of the Data Controller, for example the right to legal defence.
      • iv. to send commercial information to the email address provided by you, if you are already our customer, concerning products or services similar to those you have already enjoyed (each email will allow you to reject subsequent communications by clicking on the appropriate link)

The provision of personal data for these purposes is necessary and, failing this, it will not be possible for the user to browse the website, to register and to take advantage of the services offered.

  • b) with your free and optional consent:
  • for marketing purposes:
    • for sending advertising material, direct sales and commercial information by post, e-mail, telephone (land line and/or mobile with automated calling or calling systems with and/or without the intervention of an operator), MMS/SMS;
    • for presenting offers, promotions and business opportunities;
    • for questionnaires and market research, in particular concerning De Cecco products and services

3. HOW ARE YOUR DATA USED?


Your personal data are used for collection, registration, organisation, storage, consultation, analysis, matching, processing, modification, selection, extraction, comparison, use, interconnection, crossing, blocking, communication, cancellation and destruction operations, according to a logic related to pursuing the intended purposes.
The data are processed with manual and electronic instruments, in order to guarantee their protection.
Except as expressly provided for in this information note, under no circumstances will the Data Controller make users’ personal data accessible to third parties.

4. HOW LONG IS YOUR DATA STORED FOR?


The controller retains and uses your personal data for the following periods:

  • 26 months from their acquisition for service and marketing purposes;
  • until there is an explicit cancellation request by the user, for newsletter purposes;

5. WHO CAN ACCESS YOUR DATA?

 

Your personal data is accessible to:

  • employees and/or collaborators of De Cecco or of De Cecco Group companies, in their capacity as authorised parties and/or system administrators;
  • service providers - in their capacity as data processors – who perform related, instrumental or support activities on behalf of De Cecco, for example: the management and maintenance of the website contents, customer support, customer care services, Information Technology systems management, publishing services, credit recovery, data processing services for invoicing, archiving documentation relating to customer relations, etc.

6. TO WHOM MAY YOUR DATA BE TRANSMITTED?


De Cecco may transmit your data without your express consent for service purposes:

  • to Group companies and to all other parties to whom they must be communicated, legally or by contract, in order to enable carrying out the purposes described above (e.g. credit institutions, professional firms);
  • to the judicial authorities, at their request;

These subjects will retain your data in their capacity as independent processors or controllers. In any case, we wish to reassure you that your data will not be disseminated.
On request, you have the right to obtain an updated list of appointed controllers.

7. WHERE CAN YOUR DATA BE TRANSFERRED TO?


Your data will not be transferred abroad, outside the European Union.

8. WHAT ARE YOUR RIGHTS?


Without prejudice to the limitations established by law, you have the right to:

  • a) obtain confirmation of the existence or not of the processing of your personal data and to request that such data be made available to you in a clear and understandable way;
  • b) to ask for information and, if necessary, a copy of:
    • the source and the category of your personal data:
    • the logic used, should your information be processed with electronic tools;
    • the purposes and methods of processing;
    • the identification details of the Data Controller and of the processors;
    • the subjects or categories of subjects to whom your personal data may be transmitted or who may become aware of them;
    • the period for which your data is stored or the criteria used to determine this period, whenever possible;
    • the existence of an automated decision process, including profiling. In this case you can request the logic used, the importance and the consequences
      envisaged for you;
    • the existence of adequate guarantees in case your data should be transferred to an extra-EU country or to an international organisation;
  • c) to obtain, without undue delay, the updating, modification and correction of your incorrect data or the integration of your incomplete data, should you so wish;
  • d) to obtain the limitation of the processing in case of;
    • a dispute concerning the accuracy of personal data;
    • unlawful processing by the Data Controller in order to prevent its cancellation;
    • to exercise your rights in court;
    • to verify the possible prevalence of the legitimate reasons of the Controller compared with those of the interested party;
  • e) if the processing is carried out using automatic means, to receive without impediments and in a structured, commonly used and legible format, the personal data concerning you which you have provided to us with prior consent or by contract to transmit them to another Controller or - if technically feasible - to obtain direct transmission from the Data Controller to another Data Controller;
  • f) to oppose at any time, fully or partially:
    • for legitimate and specific reasons, connected to your particular situation, the processing of personal data concerning you;
    • to the processing of personal data concerning you for marketing and/or profiling purposes where carried out (e.g. you may oppose advertising material being sent or direct sales for carrying out market research or commercial information, by means of automated call systems without the intervention of an operator, with emails and with traditional marketing methods, by telephone and paper mail).

As concerns all the cases mentioned above, if necessary, the Data Controller will notify the third parties to whom your personal data are transmitted of any exercise of these rights on your part, with the exception of specific cases (e.g. when such fulfilment proves impossible or involves the use of means manifestly disproportionate to the protected right).

  • g) to obtain, without undue delay, the cancellation, the blocking of your data or, where possible, its anonymisation:
    • if unlawfully processed;
    • if no longer necessary for the purposes for which they were collected or subsequently processed;
    • in case of revoking the consent on which the processing is based and in case there should be no other legal basis;
    • in case you opposed the processing and there are no further legitimate reasons to continue using your data;
    • if it is imposed by law;
    • should they refer to minors;

The data controller can refuse to delete your data in the case of:

  • · exercising the right to freedom of expression and of information;
  • · fulfilling a legal obligation, carrying out a duty performed in the public interest or exercising public authority;
  • · reasons of public health interest;
  • · filing in the public interest, scientific or historical research or for statistical purposes;
  • · assessment, exercising or defending a right in court;

Finally, for the processing referred to in this information note, you have the right to lodge a complaint with the Italian Authority for the Protection of Personal Data (www.garanteprivacy.it).
You can modify and revoke the consent granted and exercise your rights at any time by contacting the Data Controller and/or the data protection officer at the addresses provided in par. 1
